General Terms and Conditions (GTC) – Cardtorious

1) Scope & customers (consumers only)

  1. These Terms and Conditions apply to all purchases made via our online shop cardtorious.com.

  2. We sell only to consumers within the European Union. “Consumer” means a natural person acting for purposes which are predominantly outside their trade, business, craft or profession.

  3. We do not conclude contracts with traders/business customers. If we reasonably believe an order is placed for commercial resale, we may cancel the order and refund any payments made.

3) Products (new & sealed)

  1. We sell new, factory sealed (OVP) products (e.g., Trading Card Game sealed products and accessories), unless expressly stated otherwise.

  2. Product images are for illustration. Minor variations in packaging/design may occur.

4) Ordering process & contract conclusion

  1. Product listings are not a binding offer, but an invitation to order.

  2. By placing items in the cart and completing checkout, you submit a binding offer to purchase the items in your cart.

  3. A contract is concluded when we accept your order by (a) sending an order confirmation/acceptance e-mail or (b) dispatching the goods—whichever occurs first.

  4. We may refuse or cancel orders for legitimate reasons (e.g., suspected fraud, incorrect pricing, supplier allocation issues). If we cancel, we will refund any payments already received.

5) Prices & shipping costs

  1. All prices shown are final prices and include applicable VAT, unless stated otherwise.

  2. Shipping costs (if any) are displayed at checkout before you place the order.

  3. Free shipping: We offer free DHL shipping from €50 order value (rules/eligibility as shown at checkout).

6) Payment

We offer the payment methods shown at checkout, including PayPal and Shopify Payments (e.g., card payments depending on your checkout settings). Payment is due immediately upon order unless stated otherwise at checkout.

7) Shipping, delivery times & risk of loss

  1. We ship to addresses within the European Union using DHL.

  2. Estimated delivery times: typically 1–3 business days within Germany; delivery times to other EU countries may vary and will be displayed/communicated at checkout or in the confirmation.

  3. For consumer purchases, the risk of loss or damage passes to you only when the goods are delivered to you.

  4. Please inspect your parcel upon delivery and contact us without undue delay if goods are damaged or incorrect.

8) Pre-orders (coming releases)

  1. Pre-orders are orders for products that are not yet released or not yet in our inventory. The stated release/shipping dates are estimates and may change due to manufacturers, distributors, or logistics.

  2. Allocation / limited quantities: For trading card products, supplier allocations can be reduced. If we cannot deliver the ordered quantity, we may reduce the quantity or cancel the affected items. In such cases, we will refund the corresponding amount immediately.

  3. If your order contains both in-stock items and pre-order items, we may (a) ship everything together when the pre-order is available or (b) split shipments—depending on what is shown at checkout / communicated to you.

9) Right of withdrawal (EU consumers) & returns

  1. If you are a consumer in the EU, you generally have a statutory right of withdrawal (cooling-off period) of 14 days for distance contracts (online purchases).

  3. Diminished value: You may inspect goods as you would in a store. If you handle goods more than necessary to check their nature/characteristics/functioning (e.g., opening sealed TCG products), you may be liable for diminished value, and we may reduce the refund accordingly.

  4. Your statutory rights are not limited by any voluntary return rules.

10) Legal guarantee / warranty

Statutory warranty rights (legal guarantee) apply. This means you have the legal rights regarding defective goods provided by applicable consumer law. These rights are not excluded or limited by these Terms.

11) Liability

  1. We are liable without limitation for intent and gross negligence, and for injury to life, body or health.

  2. In cases of slight negligence, we are liable only for breach of essential contractual obligations (cardinal duties), and limited to the foreseeable damage typical for the contract.

  3. Mandatory liability under applicable laws (e.g., product liability) remains unaffected.

12) Retention of title

Goods remain our property until full payment has been received.

14) Governing law

These Terms are governed by German law. If you are a consumer, this choice of law does not deprive you of mandatory consumer protection provisions of the country where you have your habitual residence.

15) Dispute resolution / consumer arbitration

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board
